Warranty
1. Warranty Coverage
Elevate Premium Dog Tubs LLC, hereinafter referred to as the “Manufacturer”, warrants to the original purchaser of its fiberglass products (the “Product") that the Product will be free from defects in materials and workmanship under normal use and service for a period of one year from the date of purchase.
2. Warranty Claims
To make a warranty claim, the original purchaser must notify the Manufacturer in writing within the warranty period. The notice should include a description of the defect and proof of purchase (such as the original sales receipt or invoice). The Manufacturer may require the defective Product to be returned for inspection. Please note that return shipping costs are the responsibility of the purchaser and are not covered by the Manufacturer.
3. Warranty Exclusions
This warranty does not cover:
Damage caused by improper installation, use, or maintenance of the Product.
Damage caused by accidents, abuse, misuse, or negligence.
Normal wear and tear, including but not limited to scratches, dents, or fading of the Product’s finish.
Modifications or alterations to the Product made without the Manufacturer’s written consent.
Damage caused by exposure to extreme weather conditions, natural disasters, or acts of God.
Any indirect, consequential, or incidental damages arising from the use of the Product.
4. Manufacturer’s Obligation
Upon verification of a warranty claim, the Manufacturer, at its sole discretion, will either repair or replace the defective product, or refund the original purchase price of the Product. The Manufacturer reserves the right to choose the appropriate remedy based on the nature of the defect and the availability of replacement parts.
5. Limitation of Liability
The remedies provided in this warranty are the sole and exclusive remedies for the original purchaser. The Manufacturer’s liability under this warranty is limited to the repair, replacement, or refund of the defective Product, as described in Section 4. In no event shall the Manufacturer be liable for any incidental, consequential, or special damages.
6. Governing Law
This warranty shall be governed by and construed in accordance with the laws of the jurisdiction in which the product was purchased, without regard to its conflict of law principles.
